This Acceptable Use Policy applies to Plazmatel and all of its affiliated entities. It sets forth activities prohibited by Plazmatel for users of Plazmatel services. This policy is applicable to each customer of Plazmatel and any users who gain access to the services through a customer. All capitalized terms not otherwise defined in this policy have the meanings assigned in the applicable customer agreement.
1. Purpose
This policy is intended to help protect the services provided by Plazmatel, the Plazmatel network, users of the network, the internet, and the wider internet community from improper or illegal activity. Any activity contrary to or in violation of this policy is prohibited.
2. Prohibited Activities
A user's failure to comply with this policy constitutes a violation by the customer, as determined in Plazmatel's sole discretion. Each failure may be treated as a separate violation. Violations may result in suspension or termination of service and may also lead to termination of a customer agreement. Customers must notify Plazmatel immediately if they know or reasonably suspect that a user is using the services in violation of this policy.
- 2.1 Illegal Use: Use of the services in violation of any law is prohibited, including but not limited to TCPA violations, slamming, intellectual property infringement, inappropriate content, export control violations, forged headers, and violations of the CAN-SPAM Act.
- 2.2 Services and Network Security: Users may not breach or attempt to breach system or network security, including unauthorized access, unauthorized monitoring, interference, fraud, denial-of-service attacks, or virus transmission.
- 2.3 Email and Usenet News: Unsolicited email, unauthorized email relay, improper newsgroup postings, and bulk email without consent are prohibited. Causing Plazmatel IP addresses to be blacklisted through abuse is also prohibited.
- 2.4 Complaints: Customers must respond to complaints within 24 hours. Excessive complaints or failure to comply may result in suspension or termination.
3. Warning, Suspension, and Termination
- Warning: Notification is issued with corrective action required.
- Suspension: Service may be temporarily disabled with conditions for restoration.
- Termination: Service and any related agreement may be terminated without prior notice.
4. Miscellaneous
Failure to enforce this policy at any time does not waive the right to enforce it later. Plazmatel does not monitor all content but may act when a violation is suspected. Plazmatel may cooperate with law enforcement and may update this policy from time to time by notice or by posting an updated version on the website.
